Steps to follow when deciding to buy a property

About the steps to follow
Once you have decided to purchase a property in Mexico, we suggest you complete the following steps. You can contact one of our offices to schedule an appointment with an attorney who will assist you with the required documents and the process. There is no charge for this service.
Closing Documents
Our in-house legal counsel will collect and verify all documents required for the transaction. We will accompany, assist, and review the work of the Notary Public prior to closing. Once all documentation and title research is completed, the seller and buyer will execute a Deed of Sale by which the title is transferred. This deed is called a “Public Instrument,” which is the final document that certifies the acquisition of the rights related to the property and will be registered in the Public Registry.

At this point, the remaining closing costs are due. This includes the real estate transfer tax, personal property and value added tax, final appraiser fees, final notary closing fees, bank fees (if applicable), prorated taxes and assessments for the remaining portion of the calendar year, working capital (if necessary), and other costs that are identified for you in the Estimated Closing Costs that we will provide you. These amounts will be confirmed to you prior to signing the Deed of Sale.

All public documents must be prepared in Spanish, however, we will provide an English translation for your information.

Please note that in the event of any discrepancies only the Spanish version will prevail. If you have any questions throughout the process, you can contact our legal department.
Post-closing
Once the deed of sale is signed, MexLaw will verify that all taxes, condo fees, and utilities are paid up to date. Under Mexican law, the buyer's rights can be challenged by a third party if the title has not been registered. Our attorneys will verify to ensure that the deed is registered in the Public Registry.

We also back up our Title Guarantee by providing a certificate that the title is free and clear and cannot be challenged. As the buyer, you should receive a copy of the title deed. Never assume that the title has been transferred to your name without proof. You can trust that we provide such proof.

Escrow Services
When purchasing a property, an important consideration will be determining under what conditions the transaction funds will be held and distributed. In most markets, attorneys or brokers will hold the transaction funds on behalf of the buyer. This is not recommended in Mexico, as neither Mexican notaries, attorneys, nor real estate agents are certified by a government authority and cannot legally hold funds “in escrow.”

Acceza offers fully insured escrow services by receiving the funds “in escrow” in a special segregated account held at a banking institution. These funds are insured by our professional organization for a per transaction amount.
